Terms of Service

By creating an account or using SustivioLabs (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. Who Can Use SustivioLabs
The Service is intended for solar installation companies, EPC firms, and their authorized staff, acting in a business capacity. You must be at least 18 years old and legally able to enter into a binding agreement. The Service is not directed at or intended for individual homeowners as end consumers.
2. Account Registration & Security
You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your password. You are responsible for all activity that occurs under your account. Notify us immediately at admin1@sustiviolabs.in if you suspect unauthorized access.
3. Description of Service
SustivioLabs provides tools to estimate rooftop solar system sizing, cost, government subsidy eligibility, financial payback, and emissions impact, based on inputs you provide and reference datasets we maintain (location data, electricity tariffs, cost bands, solar irradiance, and grid carbon factors). The Service can generate downloadable PDF reports from these calculations.
4. Accuracy of Calculations — Please Read Carefully
All figures produced by the Service — system size, cost, subsidy amount, savings, and payback period — are estimates, not guarantees. They are generated from the data and assumptions built into our calculation engine at the time of use. Actual results depend on factors we do not control and cannot verify: on-site conditions (shading, roof condition, installation quality), future changes to electricity tariffs, and the outcome of the actual government subsidy application process, which is administered by government bodies, not by us.
You are solely responsible for independently verifying all figures before presenting them to your own customers as a binding quote or commitment. SustivioLabs is a planning and estimation tool, not a substitute for a site survey, a licensed engineer's assessment, or an official subsidy determination.
5. Subscription & Fees
Certain features of the Service may be offered on a paid subscription basis. Pricing, billing frequency, and cancellation terms for any paid tier will be presented to you at the time of signup for that tier and are incorporated into these Terms by reference. We reserve the right to change pricing for future billing periods with reasonable notice.
6. Acceptable Use
You agree not to: resell or sublicense access to the Service without our written consent; scrape, reverse-engineer, or bulk-extract our underlying datasets or calculation logic; attempt to circumvent rate limiting or other technical safeguards; impersonate another user or organization; or use the Service for any unlawful purpose.
7. Intellectual Property
SustivioLabs retains all rights to the Service, including our proprietary datasets (PIN code mappings, tariff data, cost bands, tilt-angle data, carbon factors), calculation methodology, and software. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your own business purposes — not a license to the underlying data or code itself.
8. Your Reports & Your Customers
Reports you generate are yours to use with your own customers, under your own branding, at your own discretion. SustivioLabs does not claim ownership over the reports you generate or any relationship you have with your end customers. As set out in Section 4, you remain responsible for the accuracy of what you present to them.
9. Termination
You may stop using the Service and delete your account at any time via Settings. We may suspend or terminate accounts that violate these Terms, engage in abuse, or (for paid tiers) fail to maintain payment, with notice where reasonably practicable.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that calculation outputs will be accurate for any specific real-world installation.
11. Limitation of Liability
To the maximum extent permitted by law, SustivioLabs' total liability arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost business, lost subsidy, or losses arising from an installation carried out based on figures generated by the Service.
12. Indemnification
You agree to indemnify and hold SustivioLabs harmless from any claim, loss, or damage — including from your own customers — arising out of your use of the Service, your reliance on its outputs without independent verification, or your violation of these Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
